A restraining order request filed by Taylor Frankie Paul's ex-husband, Tate Paul, on Tuesday has been denied by a Utah court commissioner.

According to a ruling obtained by **, Salt Lake City District Court Commissioner Kim M. Luhn dismissed Tate's motion for a temporary restraining order on Wednesday. The motion was filed in the yearslong divorce case between Tate and the embattled reality star known for her starring spot on *The Secret Lives of Mormon Wives* and her shelved season of *The Bachelorette*.

Tate also filed an affidavit/declaration with five accompanying exhibits, according to records obtained by EW. The court documents are under seal.

In her decision, Commissioner Luhn ruled that "many of [Tate's] supporting allegations are based upon inadmissible hearsay, without any corroborating evidence." As a result, "The court cannot find an immediate and irreparable harm as contemplated by Rule 65A, and the motion is denied."

Commissioner Luhn explained that "many of [Tate's] concerns, like the children not doing well in school and expressing sadness will require ongoing attention not remedied with an emergency order changing custody. The court acknowledges that what he is allegedly hearing can create anxiety, but contrary to the claim that the children are in immediate danger, Taylor proffers that Tate left the children with her from June 11 through the 17, 2026, while he went to Iceland."

EW has reached out to representatives for Tate and Taylor for comment.

Tate's filing came the same day that a source close to Taylor told PEOPLE that Taylor recently checked in for a voluntary stint in a mental health treatment facility. A source close to the reality star tells EW that the move came at the recommendation of her doctor, that "she was cleared, has since departed, and is home."

According to TMZ, which first reported the news of the restraining order filing, sources close to Tate claim that he is seeking sole custody of their two children: Indy, 8, and Ocean, 6. Regarding the former couple's children, as well as Taylor's son Ever with ex Dakota Mortensen, PEOPLE's source remarked, "Everyone is just trying to protect the kids."

These developments are the latest in a dramatic saga centered on Taylor, involving allegations of domestic abuse between her and Mortensen; Mortensen filing for his own restraining order, which was granted; production on *Secret Lives of Mormon Wives *season 5 abruptly pausing amid an investigation into Taylor's and Mortensen's relationship, and ABC pulling the plug on Taylor's season of *The Bachelorette*.

On April 30, a court commissioner recommended that mutual protective orders which established Taylor and Moretensen are not to come within 100 feet of one another should be extended to three years. Should either individual violate the terms of their protective order, they could face criminal charges.

At the time, Commissioner Russell Minas upheld his own advisement, issued earlier that month, that Taylor be granted eight hours per week of supervised parent time with Ever. On June 1, Minas lifted the supervision requirement for Taylor's parental visits. Her recommended time was also expanded to one consistent weekday (not overnight) and alternating weekends with Mortensen.
